Publicly available information released following an FOI access request

NHMRC is required by section 11C of the Freedom of Information Act 1982 to publish a disclosure log on its website. The disclosure log lists information which has been released in response to an FOI access request. This requirement has applied since 1 May 2011.

The disclosure log requirement does not apply to:

  • personal information about any person if publication of that information would be unreasonable
  • information about the business, commercial, financial or professional affairs of any person if publication of that information would be unreasonable
  • other information covered by a determination made by the Australian Information Commissioner if publication of that information would be unreasonable
  • any information if it is not reasonably practicable to publish the information because of the extent of modifications that would need to be made to delete the information listed in the above dot points.
  • Information attached to, or referred to, in NHMRC’s disclosure log may be removed after 12 months, unless the information has enduring public value.

  • documents, or a list of anyone NHMRC has funded for any and all short and long term research/studies, that are relied upon for the risk and safety assessment regarding the Diphtheria, Pertussis and Tetanus vaccine, as well as the Hexaxim, Infanrix, Infanrix hexa, Infanrix IPV, Quadracel, Tripacel, and Immunoglobulin (+/-) vaccines, as well as a tetanus only vaccine, concerning healthy children, children with neutropenia, and also children with a family history of ADEM (Acute disseminated encephalomyelitis) related vaccine injury
  • studies NHMRC has funded regarding the safety and effects of formaldehyde on the living human body.

One document released in full containing publically available grant information, however, access refused to most parts of the request under subsection 24A(1) of the FOI Act on the basis that the documents requested do not exist within NHMRC as these matters are the role of another government agency.

  • all documents relating to the rescinding of the NHMRC Guidelines contained within the publication titled “Boxing Injuries” (the Report), including but not limited to written submissions by government agencies and non-governmental bodies, internal memoranda, research reports and data, any new evidence to support the rescission and the basis for rescission of said guidelines 
  • all documents or the like detailing the process of rescinding the above NHMRC Guidelines from its inception to actual rescission, including dates of the various stages of the rescission process 
  • in the preparation of the Report, position statements obtained from specified medical colleges, societies and associations, as well as specified publications and documents referred to in the bibliography of the Report
